The Chocolate Destinations Group Terms and Conditions

1. Product Substitution

We reserve the right to substitute items in hampers and gift boxes if specific products are unavailable at the time of packing. All substitutions will be of equal or greater value and will match the theme and quality of the original item wherever possible.

2. Delivery Terms

Delivery timeframes provided are estimates only and do not include processing times.

  1. Order Processing Time:
    1. Orders are processed within 2–4 business days before dispatch.
    2. During peak periods (e.g. Christmas, Easter, sales events), processing may take longer.
  2. Dispatch Schedule: We do not dispatch orders on weekends or on Victorian or national public holidays.
  3. Delivery Method:
    1. Orders sent to regional Victoria and interstate are sent via Australia Post.
    2. This service is not refrigerated.
    3. We use insulated packaging to help protect the chocolate during transit.
  4. Incorrect Address Information: Orders with incorrect suburb or postcode information will automatically be sent via Express Post.
  5. Unforeseen Delays: While we make every effort to ensure timely delivery, we are not responsible for delays due to:
    1. Weather events
    2. Courier or postal service disruptions
    3. Traffic incidents or other unforeseen circumstances

We recommend checking your address carefully before placing your order and placing orders early during busy periods.

3. Refunds & Returns

We take great care in preparing your order. If you receive:

  1. Damaged or faulty items,
  2. The wrong product, or
  3. An order that’s incomplete,

Please contact us within 48 hours of delivery, including:

  1. Your order number
  2. A clear photo of the product(s) and packaging
  3. A description of the issue

We may offer a refund, replacement, or credit at our discretion, in accordance with the Australian Consumer Law. We do not accept returns for change of mind, or for products that are perishable, opened or not stored appropriately.

4. Cancellations

  1. To cancel an order, please contact us as soon as possible.
  2. If your order has not yet been processed, we may be able to cancel it.
  3. Once processing has begun, we cannot guarantee cancellation or refunds, especially for customised or perishable items.

5. Acceptance of Terms

By placing an order with The Chocolate Destinations Group:

  1. You confirm that all details you’ve provided are true and accurate.
  2. You agree to these Terms & Conditions, and to our Privacy Policy.
  3. You acknowledge that delays, substitutions, or minor variations may occur.

These Terms of Use apply to your access to, and use of the websites operated by The Chocolate Destinations Group Australia Pty Ltd (ABN 53 151 187 745) (“we”, “us”, “our”). By accessing, browsing, or using our websites, you agree to be bound by these Terms and our Privacy Policy.

  1. Definitions
    In these Terms:
    1. “Websites” means all websites we operate or control, including:

      associated subdomains, mobile sites, apps, social media platforms, APIs and widgets.
    2. “Website” refers to any single one of our websites.
    3. “You” means the individual or entity accessing or using our websites.
    4. “Personal Data” has the meaning set out in our Privacy Policy.
    5. “Third Party Content” refers to content owned or controlled by other parties, including linked websites, external services, and partner platforms.
  2. Use of Our Websites
    1. Access to our Websites is provided on a temporary basis. We may withdraw or change content, features, or access without notice. We are not liable if the Websites are unavailable at any time or for any period.
    2. You may only use our Websites for lawful purposes and in accordance with these Terms.
  3. Variations to these terms
    1. We may update or amend these Terms at any time by publishing the revised version on our Websites. Continued use of the Websites after a change means you accept the revised Terms.
    2. If you do not agree with the Terms or any changes, you must stop using the Websites immediately.

    2. We may take any action we deem necessary (including legal action or account suspension) to prevent unauthorised use or misuse of the Websites.

    1. Check with Daniel, but I don’t think we require anyone to set up an account with us.
  7. Orders & Gift Cards
    1. Your purchase of products through the Websites is governed by our:

      1. Online Terms of Sale, and

      which are incorporated into these Terms by reference.
  8. Third Party Content
    1. Our Websites may contain links to third party websites, products or services.
    2. We do not control, endorse, or guarantee the accuracy, relevance, or quality of Third Party Content. You access it at your own risk, and it may be subject to separate terms and conditions.
    3. We are not responsible for any loss or damage arising from your reliance on Third Party Content.
  9. Privacy & Cookies
    1. We handle your personal data in accordance with our Privacy Policy, which forms part of these Terms.
    2. Our websites use cookies to improve your experience. If you disable cookies, some features may not function correctly.
  10. Disclaimer
    1. To the extent permitted by law:
      1. The Websites are provided “as is” and “as available”, without warranties of any kind;
      2. We do not guarantee that the content is accurate, complete, or free of errors or viruses;
      3. Access may be interrupted, restricted, or delayed due to factors outside our control;
      4. We are not liable for any content posted by third parties or for actions taken by users.
  11. Australian Consumer Law
    1. Nothing in these Terms limits your rights under the Australian Consumer Law.
    2. Where those rights apply and we are permitted to limit our liability, our liability is limited to either:
      1. Resupplying the relevant services, or
      2. Paying the cost of resupplying them.
  12. Indemnity
    1. You agree to indemnify and hold us (and our officers, employees, and affiliates) harmless against all claims, losses, damages, costs or liabilities arising out of:
      1. Your use or misuse of the Websites,
      2. Any breach of these Terms by you,
      3. Your violation of any rights of another person.
  13. Severability
    1. If any part of these Terms is found to be unenforceable or invalid, the remaining parts will remain in full force and effect.
  14. Complaints and Disputes
    1. We welcome your feedback. If you have a concern or complaint, please contact our support team so we can attempt to resolve the issue with you directly.
  15. Governing Law
    1. These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria in relation to any disputes.

Terms of Sale

These Terms of Sale apply when you purchase products or gift cards from www.yvci.com.au, www.gorci.com.au, and www.mpchoc.com.au (the “Website”). By placing an order, you agree to be bound by:

These Terms form a legally binding agreement between The Chocolate Destinations Group Australia Pty Ltd (ABN 53 151 187 745) (“The Chocolate Destinations Group”, “we”, “us”, “our”) and you (“you”, “your”).

  1. Overview
    1. These Terms govern the ordering, purchase, fulfilment, and delivery of products and gift cards (“Products”) from the Website.
    2. You must be at least 18 years of age to purchase from our Website. We take no responsibility for orders made in breach of this requirement.
    3. Orders are also subject to the terms and conditions of our ecommerce platform provider, Shopify.
  2. Placing Orders
    1. By placing an order, you are making an offer to purchase the selected Products for the listed price, plus any applicable delivery charges.
    2. All orders are subject to our acceptance. We may reject or cancel your order for any reason, including errors in stock, pricing, or delivery details. If we cancel your order after payment, you’ll receive a full refund.
    3. You must provide accurate delivery and payment information when placing your order. We are not responsible for any loss resulting from incorrect or incomplete information provided by you.
    4. Products are for personal use only. Orders must not be placed for resale or commercial distribution.
  3. Pricing & Charges
    1. Product prices are shown in Australian Dollars (AUD) and include GST unless otherwise stated.
    2. Delivery charges (if applicable) will be clearly shown at checkout.
    3. We may change prices at any time without notice. Prices displayed at the time of order are final, except in cases of error.
    4. If a pricing error occurs, we may cancel or amend the order before delivery. You’ll be notified of the error and offered a refund or alternative.
  4. Payment
    1. Payment must be made in full at the time of ordering. We accept payment via methods available at checkout.
    2. By placing an order, you confirm that you are authorised to use the payment method provided.
    3. If payment is declined or unsuccessful, we may cancel the order.
  5. Product Availability
    1. All products are offered subject to availability. If an item is out of stock or cannot be fulfilled, we’ll notify you and offer an alternative, backorder, or refund.
  6. Click & Collect
    1. Click & Collect may be offered at selected Chocolateries and times.
    2. You must collect your entire order within the nominated time slot. No partial pickups are available.
    3. Please bring your confirmation email and valid ID when collecting.
    4. If not collected within ten (10) days, your order may be returned to the store and cancelled.
    5. No changes, refunds, or exchanges can be made at the collection point.
    6. Stock availability varies between Chocolateries.
    7. If we are unable to fulfil your order, we’ll contact you before your collection time to:
      • Offer a substitute item of equal or higher value, or
      • Cancel your order and issue a refund.
    8. For assistance, please contact us via our website or reach out to the relevant The Chocolate Destinations Group venue.
  7. Refunds & Returns
    1. If a refund is due (under these Terms or the law), we will process it within five (5) business days. Timing of funds returning to your account depends on your financial institution.
    2. For information on returns and consumer guarantees, refer to our Returns Policy and section 10 (Australian Consumer Law) below.
  8. Promotions, Competitions & Discounts
    1. Promotional offers, discounts, and competitions may have additional terms and conditions. Please review those before participating.
    2. Promotional gifts:
      • Are not redeemable for cash;
      • Cannot be applied to gift card purchases;
      • Are limited to one per order unless otherwise stated.
    3. We may withdraw or amend any promotional offer without notice. Product availability is not guaranteed during promotional periods.
  9. Liability
    1. To the extent permitted by law, The Chocolate Destinations Group excludes all liability for any loss, damage, cost, or expense (whether direct, indirect, or consequential) related to your purchase or use of Products.
    2. If our liability cannot be excluded, we limit it to:
      • Resupplying the Product, or
      • Paying the cost of resupply
    3. We are not liable for any delay or failure due to causes beyond our reasonable control.
  10. Governing Law
    1. These Terms of Sale are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.

Gift Card Terms & Conditions

These terms apply to the purchase and use of The Chocolate Destinations Group Gift Cards (“Gift Cards”) issued by The Chocolate Destinations Group Australia Pty Ltd (ABN 53 151 187 745). By purchasing or using a Gift Card, you agree to be bound by these terms, as well as our Terms of Sale and Privacy Policy.

  1. Purchasing Gift Cards
    1. Gift Cards are available for purchase at any The Chocolate Destinations Group retail store in Australia or via our online store at https://www.gorci.com.au/shop/.
    2. You can load a Gift Card with a value between $25 and $250 AUD.
    3. All Gift Card values include GST (where applicable).
  2. Using Gift Cards
    1. Gift Cards can be redeemed at:
    2. Gift Cards are not valid for:
      • Corporate or wholesale purchases, or
      • Products sold through third-party retailers.
    3. Gift Cards may only be used for purchases of $25 or more.
    4. If your order total exceeds the Gift Card balance, the remaining amount must be paid using another accepted payment method.
    5. Gift Cards are partially redeemable. Any unused balance will remain available for future purchases until the card expires.
    6. Gift Card balances can be checked at any The Chocolate Destinations Group retail store.
  3. Limitations & Restrictions
    1. Gift Cards are non-reloadable and non-refundable.
    2. They cannot be redeemed for cash, exchanged for another Gift Card, or used to purchase additional Gift Cards.
    3. Lost, stolen, or damaged Gift Cards will not be replaced. You are responsible for keeping your Gift Card safe.
  4. Expiry & Validity
    1. Gift Cards are valid for 3 years from the date of issue.
    2. Any unused balance after the expiry date will be forfeited and is not refundable.
  5. Fraud & Misuse
    1. If The Chocolate Destinations Group suspects a Gift Card has been obtained, altered, or used fraudulently or in breach of these terms, we may:
      • Refuse to redeem the Gift Card, or
      • Suspend or cancel the Gift Card until we are satisfied that no fraud has occurred.
